Our “Website” includes the official corporate websites administered by Pampered Chef (pamperedchef.com and pamperedchef.ca), authorized Independent Consultant websites that are made available and technically maintained and hosted by Pampered Chef, the Consultant–only part of our website (known as “Consultant’s Corner”), and any personal information you provide to a Pampered Chef Independent Consultant that is transferred to us through our websites (we collectively refer to these sources as the “Website”). This Privacy Policy is incorporated into our Terms of Use.

Our Privacy Policy explains how we collect, use, and disclose personal information and the steps we take to secure such personal information.

1. INFORMATION WE COLLECT

Without limitation, any of the following personal information may be collected: name; date of birth; age; addresses; email address; gender; telephone number; job title; profession; education level; income; payment information (including credit or debit card number, expiration date and any other associated payment information); as well as other information such as order details, purchase history, purchase preferences and interests and other commercial and transaction information; name of your Independent Consultant; communication preferences; username; password; security questions and answers; and any other personal information that you provide to us.

If you apply to be or become an Independent Consultant, we may also ask for your social security number, your banking information and, if applicable, your tax identification number.

If you do not provide a piece of the information we request in connection with a transaction on the Website or with an Independent Consultant, we may not be able to complete your transaction and may try to contact you.

We collect this personal information: (a) directly from you when you provide it to us, (b) automatically as you navigate through the Website (see the “Automatically Collected Information” section below) or otherwise engage with use online, including our pages in social media platforms or our emails, and (c) from third parties, for example, our Independent Consultants and others as described in the “Third Parties” section below.

Information collected automatically may include but is not limited to, usage details, IP addresses, computer or device type, internet browser type, computer or device ID, and other information collected through cookies, web beacons, pixels, and other data collection technologies. If you would like more information about the cookies, web beacons, pixels, and other data collection technologies we use, please see the section below titled “Cookies, Web Beacons and Other Technologies by Advertisers”.

2. HOW WE USE YOUR INFORMATION

We may use or disclose the personal information we collect for various purposes related to our business, including to:

  • • help us create, develop, operate, deliver and improve our products, services, content, recommendations, and marketing;
  • • send notices, such as communications about purchases, promotional materials, and changes to our terms, conditions and policies
  • • conduct auditing, data analysis, and research to improve our products, services and customer communications;
  • • create and verify your account profile;
  • • process and fulfill your order;
  • • if you are an Independent Consultant, process or fulfill the terms of a consultant agreement or your work as a consultant;
  • • provide you with information and customer service in response to your specific request or respond to any of your other inquiries;
  • • communicate with you, including via email, social media, text message, and telephone calls, for both transactional and commercial purposes, including to provide you with security alerts and shipping updates or offer you information and updates on products or services we think that you may be interested in;
  • • provide you with information on the Company’s or a third-party’s goods or services (either on a personalized or aggregate basis);
  • • improve the content and navigation on the Website;
  • • review advertising and promotional program performance, delivery verification and measurement;
  • • support and better understand Independent Consultant and consumer preferences and perform data analytics, including by combining the information we collect from you with information we collect from other sources;
  • • administer and manage online features and communities for the sharing and exchange of reviews, comments, feedback, and other user generated content;
  • • if you enter into a sweepstake, contest or similar promotional programs or sign up for other online experiences (e.g., Live Cooking Events), administer those programs and online experiences;
  • • provide offers or information relating to the Company and related business opportunity;
  • • enforce our Terms of Use;
  • • resolve disputes;
  • • prevent and detect fraud; and
  • • otherwise help us to comply with the law, regulation and/or legal process.

As discussed above, we may use personal information we collect to communicate with you via text message, including (with your consent, if necessary) to market to you or offer you information and updates on products or services we think you may be interested in. Text messages may be sent using an automatic telephone dialing system or other technology. Please note that we may disclose your personal information as is reasonably necessary to comply with the law or protect our rights or the rights of others.

3. HOW WE DISCLOSE YOUR INFORMATION

At times, we may use or disclose certain personal information to third parties including, but not limited to, (a) our affiliates and subsidiaries, (b) contractors, service providers (including customer service vendors, quality assurance vendors, cloud storage providers, security safety vendors, and marketing, communication, and text messaging service providers) and other third parties including, without limitation, Pampered Chef Independent Consultants, (c) data analytics service providers, (d) service providers engaged to fulfill orders or deliver products and/or services to you or your gift recipient; (e) vendors engaged to support the operation of our Website (e.g., product ratings and reviews, payment processors); (f) service providers engaged to conduct research and satisfaction type surveys and quizzes, (g) providers of marketing, advertising and promotional services and social media platforms, (h) payment processors, and (i) others for any other purpose disclosed by us when you provide the information or with your consent.

4. THIRD PARTIES

Pampered Chef has business relationships with several third-parties for transactions which may be subject to policies in addition to this Privacy Policy.

  • • We partner with companies that administer rewards and other incentive programs that enable the delivery of customizable content and offers to participants in their programs, including rebates and other special offers. Such companies collect and provide access to information about your purchasing habits, your engagement with our content and your participation in our offers. You should review the privacy policies and terms applicable to such programs before agreeing to participate.
  • • With respect to the processing of payments and depending on the payment method chosen and available, we may also disclose your personal information to any other involved payment provider and processor.

For example, we use the payment services provided by PayPal, Inc. and all companies in which PayPal or its successor directly or indirectly from time to time owns or controls (“PayPal”). PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which represent virtual private or business accounts. PayPal is also able to process virtual payments through credit cards when a user does not have a PayPal account. If you choose “PayPal” as payment option, we automatically transmit your data to PayPal. By selecting PayPal as payment option, you agree to the transfer of personal data required for payment processing. The data transmitted to PayPal is usually first name, last name, address, email address, IP address, telephone number, mobile phone number, and other data if this is necessary for the payment processing.

  • • We may also receive information about you from social media platforms (e.g., Facebook, Instagram, TikTok, YouTube, and Pinterest) if you allow these platforms to provide us access to your profile and other personal information, if you engage with our content on these platforms, or if you interact with our social media pages in these platforms. The type of information that we may receive includes actions within or linking from our advertising content. You should review the privacy policies and applicable terms of the social media platforms and adjust your settings as appropriate. For example, we partner with Facebook, Inc. and may transmit and receive certain data to fulfill certain transactions that occur on Instagram. To the extent that this Privacy Policy is inconsistent with the privacy and other policies of such social media platforms, those policies will prevail with respect to such data and transactions.
  • • When you create an account or log into our Website through a social media service or similar tool, such as through Facebook or Twitter, any information that these third party social media services collect as a result of your use of those sign-in tools is subject to those respective entities’ own privacy policies. If you sign-in to our Website using such third party sign-in tools, certain information from those third party services will be transmitted to us.
  • • Links to third party websites may be provided on this Website or when you engage with that third party. We do not control and are not responsible for any of these websites and their content. We do not endorse or make any representations about such websites or any information or materials found there or any results that may be obtained from using them. Since we do not control these websites, we assume no responsibility for the privacy practices of such websites. We encourage you to review the privacy policies and terms of use posted on those third party websites.

5. AUTOMATICALLY COLLECTED INFORMATION

As is true of many digital properties, we and our third-party partners may automatically collect certain information from or in connection with your device when visiting or interacting with our Website and related business services, including when you visit our Website, read our emails, or otherwise engage with us. We and our third-party partners typically collect this information through a variety of tracking technologies, including cookies, web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies, file information, and similar technology (collectively, “tracking technologies”), and we may use technologies from vendors to collect this information. Information we collect automatically about you may be combined with other personal information we collect directly from you or receive from other sources.

We, and our third-party partners, may use tracking technologies to automatically collect usage and device information, such as:

  • • Usage Data: Information about the way you access and use our Website and business related services, for example, the site from which you came and the site to which you are going when you leave our Website, the date and time you access the Website and how frequently you access the Website, whether you open emails or click the links contained in emails, whether you access the Website from multiple devices, and other actions you take on the Website.
  • • Browsing Behavior: Information about your browsing behavior and how you use the Website, such as the pages you visit, the time spend on the pages and actions taken, the links you click, the ads you view and click on, videos you watch or download, and other similar actions.   • • Device and Related Information: Information about the computer, tablet, smartphone or other device you use, such as your IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique ID that allows us to uniquely identify your browser, mobile device, or your account (including, for example, a persistent device identifier or an Ad ID), and other such information. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which permit us to recognize and contact you across multiple devices.
  • • Limited Location Data: We collect limited information to approximate your general location based on your IP address. Pampered Chef does not collect your precise Global Positioning System (GPS) coordinates through tracking technologies.
  • • Analytics information: We may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for the services and to understand more about the demographics of our users. All of the information collected automatically through these tools allows us to improve your Independent Consultant and customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our Website and related business services, and to improve the effectiveness of our Website, offers, advertising, communications and customer service. We also use this information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including targeted content and advertising; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our Website; (e) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our Website; (f) diagnose or fix technology problems; and (g) otherwise to plan for and enhance our Website and related business services.

If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies; however, doing so may negatively impact your experience using the services, as some features and services may not work properly. 6. INFORMATION YOU MAKE PUBLIC

Any communications that you submit or post to an interactive feature such as a comment or review section, blog or message board may be viewable by other users of the Website. We are not responsible for, nor can we guarantee protection of, any information you submit or post to the interactive features of the Website. Therefore, you acknowledge and understand you have no expectation of privacy in the content you submit to those interactive features of the Website’s, whether or not it contains your private information.

7. PRIVACY CONTROLS

The Website recognizes the Global Privacy Control (“GPC”) signal. If you are using a properly configured browser setting or plug-in that sends an opt-out preference signal to each website you visit, we will treat that as a valid request to opt out of sales or sharing your personal information. Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, our Website does not currently interpret, respond to, or alter its practices when it receives “Do Not Track” signals.

8. DATA RETENTION

We store the personal information we collect about you for no longer than necessary to fulfil the purposes for which it was collected, and in accordance with our legitimate business interests and applicable law. However, if necessary, we may retain personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and accounting requirements set by a legislature, regulator or other government authority.

To determine the appropriate duration of the retention of personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting and other applicable obligations.

9. CHILDREN’S PRIVACY

This Website is a general audience website and we do not knowingly collect or process information from children under 18 years of age, unless we have the appropriate consents or other permissions under applicable law. If you are under 18, do not use or provide any information on the Website. If we learn that we have information of a child under the age of 18 without verification of parental consent, we will permanently delete that information. Whether you place an order, create a profile or enter into a consultant agreement, we recognize the importance of maintaining the security of our customers’ personal information. We use commercially reasonable security measures, including physical, administrative, and technical safeguards to protect your personal information. Here are some examples of security measures we use to protect your personal information:

  • • Passwords are required to access your online account and help to protect your account information. Please keep this password confidential.
  • • Encryption technology, called Transport Layer Security (TLS), helps to protect personal information in certain areas of our Website during transport across the Internet. The presence of TLS encryption may be indicated by https in the browser URL or the image of a closed lock or solid key in the browser window. These indications may not be present in mobile services that use TLS.
  • • For payment card information, we use secured networks, encryption or other protection of cardholder data, physical and technical access controls, monitoring and tests of security systems, and other information security practices to help to protect your information.

In addition, we use commercially reasonable measures to protect the customer data against unauthorized access. Unfortunately, however, no data transmission over the internet or stored on computer systems can be guaranteed to be 100% secure. As a result, while we strive to protect your information we do not guarantee or warrant the security of any information you transmit to or from our Website, and you do so at your own risk. We are not responsible for the actions of unaffiliated third parties.

11. COOKIES, WEB BEACONS AND OTHER TECHNOLOGIES BY ADVERTISERS

We may participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your browsing history. We permit third party online advertising networks, social media companies and other third-party services to collect information about your use of our online services over time so that they may play or display ads on our Website, on other websites you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through tracking technologies, such as cookies, web beacons, pixels, embedded scripts, location-identifying technologies, and similar technology, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the Website, Ad ID, and other similar information. 12. FINANCIAL INCENTIVES

We may offer financial incentives to promote our products or services. These financial incentives may include credits, discounts, coupons and other benefits or rewards when you sign up for one of our programs, such as when you subscribe to receive emails or other communications from us, take surveys and quizzes to enable us to learn about your preferences and deliver product or service recommendations, join a loyalty program, or participate in a sweepstake, contest, or other promotion. We may collect your personal information to incentivize your participation and administer those programs. Participation in those programs is optional. The financial incentive terms will be presented to you before you are given the option to sign up for the program. You may withdraw from the program at any time by using the method designated at the time of sign up or as described in the program’s terms and conditions, and if no other method is designated for the applicable program, by contacting us as described in this Privacy Policy. We estimate the value of your personal information is reasonably related to the value of the financial incentive presented to you.

We also reserve the right, at our sole discretion, to forward the information you submit to any subsidiaries and affiliates for legitimate business purposes. Nothing in this Privacy Policy, our Terms of Use or contained in the Website shall constitute a promise by us to interview, hire or employ any individual who submits information to us, nor shall anything in this Privacy Policy, our Terms of Use or contained in the Website constitute a promise that we will review any or all of the information submitted to us by users. 14. APPLICABLE LAWS AND DATA TRANSFERS

You acknowledge that we are principally located in the United States and have offices and engage service providers in other countries and, accordingly, your information may be transferred to, processed, analyzed, and stored in the United States and countries other than the country from which you accessed our Website and your information was collected. That means the information you provide to us may be transferred to a country whose laws may not provide the same level of privacy protection for your personal information as your home country.

By using our Website you consent to the adjudication of any disputes in the federal courts of, and in accordance with the laws of, the State of Illinois.

Sensitive Information

We may receive, or process personal information to create, deidentified information that can no longer reasonably be used to infer information about, or otherwise be linked to, a particular individual or household. Where we maintain deidentified information, we will maintain and use the information in deidentified form and not attempt to reidentify the information except as required or permitted by law.

Authorized Agents

Minors
